Definitions

1.1 The ‘tour’ means a guided trail tour on off road motorcycles provided by ‘Riders of the Lost Trail’

1.2 The ‘customer’ means the person who takes part in the activity.

1.3 The ‘conditions’ means the terms and conditions set out in this document.

1.4 The ‘contract’ means the provision of services between Riders of the Lost Trail and the customer.

1.5 The ‘company’ means Riders of the Lost Trail.

1.6 The ‘equipment’ means all property of Riders of the Lost Trail, including all motorcycles, all riding clothing, protection equipment and tools, and the contents of storage unit where Riders of the Lost Trail is located.

Terms and Conditions Applicable

2.1.1 The conditions apply to the contract to the exclusion of all other terms and conditions.

2.2 Any variation to these conditions (including any special terms and conditions agreed between parties) shall be inapplicable unless agreed in writing by Riders of the Lost Trail.

2.3 Each customer shall pay the company a deposit of 50% of the value of the riding aspect of the tour. This is based on the cost of £150.00 per day / per person. For example, if a customer wants to take part in a 3 day riding tour, then the full amount due would be £450.00 and therefore a 50% deposit payment of £225.00 would be required to confirm the booking.

The final 50% balance will be required no later than 2 weeks before the tour commences.

The accommodation costs and any airport transfers will be paid to the company in cash, in Euros, upon arrival. The customer will be sent an email prior to arrival, which will outline all costs relating to accommodation and airport transfers.

The customer’s commitment starts 8 weeks before the tour start date, even if you have not paid the final balance in full. If the customer cancels after this date, then he/she shall be invoiced for any outstanding balances. This is to protect us and allow us enough time to fill the dates that you have committed to.

The following schedule refers to refunds and cancellations:

7-8 weeks prior to start of tour - 50% refund

4-6 weeks prior to start of tour - 40% refund

2-4 weeks prior to start of tour - 25% refund

0-2 weeks prior to start of tour - no refund

* IMPORTANT *

If you decide to cut short your tour with us for any reason, or do not turn up on a particular day on a multi-day tour; then the company is not at liberty to offer a refund or re-organise another tour.

2.4 All customers must hold a full and valid motorcycle licence for the type of motorcycle that will be used on the tour. This must be presented to a representative of the company before the commencement of any tour.

2.5 The contract shall be formed at the time of acceptance by the company of a booking of a tour by a customer and upon the payment to the company of the deposit.

2.6 The company doesn’t employ a damages policy where the customer is liable for damage to any property of the company. This is based on reasonable usage of the company’s equipment. If it is deemed that the customer is using the company’s equipment in an unreasonable and irresponsible manner, then the customer will be liable to pay the full costs of any damage incurred. This will be at the discretion of employees of the company.

2.7 The company reserves the right to cancel a tour without notice. In the event of such a cancellation, all payments received by the company from the customer will be fully refunded.

2.8 If the customer leaves the tour voluntarily before the end of the tour, or is required to do so by a company representative, on the grounds that the customer’s presence is considered detrimental to the safety or well being of the tour or anyone on the tour, then the liability the company may have towards that customer will immediately cease. The company will have no responsibility for repatriation or any other expense incurred by the customer as a result of such an event. No refund will be given.

2.9 The customer understands that he/ she is responsible for his / her own personal accident and repatriation insurance. The company does not provide any form of personal accident insurance, and therefore urges the customer to acknowledge the inherent risk and dangers of a tour, and will travel entirely at the customer’s own risk and neither the company, its agents, or any other person assisting with them, is liable for any personal loss, injury, accident, damage, delay or inconvenience, whether caused by acts of the company, its agents or events outside the company’s control.
